GoboHost.com TOS (Terms of Service)

The Terms of Service (TOS) are the rules and regulations that specify guidelines for using our services or information. All use of our services or information is subject to these terms. Please read them carefully and ensure you understand and agree to all parts. Use of this site’s services implies agreement with these terms!

Indemnification: Under no circumstances will Gobohost.com be held liable for damages resulting from any interruption of service for an amount greater than the amount charged to the client for services rendered during the period damages occurred. Clients also acknowledges that in no case will Gobohost.com be liable for damages as a result of its own negligence in excess of the charges payable by the client for services during the period damages occurred. Client acknowledges that they make use of Gobohost.com services, information, data, file downloads, blog entries including GBlog and facilities at their own risk.

Rates: Client acknowledges that they have been made adequately aware of the initial rates and fees associated with services being rendered by Gobohost.com and have received a complete description of services to be rendered. Client also acknowledges that Gobohost.com reserves the right to change the specified rates and charges from time to time. Where possible, Gobohost.com will provide the Client with a minimum of 30 days notice of any rate changes.

Payments and Fees: Client acknowledges that Gobohost.com is under no obligation to provide services under the terms of this Agreement until all stated charges have been paid-in-full, and Gobohost.com has been able to adequately verify the validity of said payment.

Refund Policy: GoboHost.com offers a 30-day money-back guarantee on hosting services. Payments for other services, such as, website design and programming, dedicated server hosting, co-location, domain registration, or any other services rendered for the Client by GoboHost.com are completely non-refundable under any circumstances. In addition, if your account is canceled by the company for violation of this Agreement or the attached Acceptable Use Policy, all payments made to GoboHost.com becomes completely non- refundable.

Service Cancellation: Requests to cancel services may be made by notifying our Billing Department from within our billing and GoboControl system. All requests for service cancellation must be made a minimum of 5 days prior to the renewal date of the service being cancelled. All cancellation requests received within 5 days of the renewal date will be made effective the following renewal date. Where all services are considered to be provided on a strictly prepaid basis, no prorated or partial refunds will be made when the cancellation procedure outlined above has not been followed.

Credit Card Payments: Where available, the Client authorizes GoboHost.com to automatically debit the credit card placed on file with GoboHost.com during the ordering process on the due date of each subsequent invoice. Invoices will be emailed to the Client prior to any credit card charges being placed at the end of each billing period. Should the Client’s credit card be declined for any reason, GoboHost.com will contact client to notify them of the declined charge, and will attempt to resubmit the credit card on file for up to 10 days. Accounts that is still uncollected after 10 days may be subject to suspension or termination as per this agreement.

Client acknowledges that usage of services provided by Gobohost.com constitutes acceptance of the following Acceptable Use Policy. GoboHost.com holds the right to ban, restrict, delete, remove, suspend, terminate or take legal action against clients using GoboHost.com services to host the fallowing content.

Free Accounts: FREE, ad supported, or any type simular sites are not permitted to be hosted.

Illegal Use: The services provided by the Company may not be used for any illegal purposes or in support of any illegal activity. The Company reserves the right to cooperate with any legal authorities and/or injured third parties in the investigation of any suspected criminal or civil wrongdoing.

Child Pornography: Use of services provided by Gobohost.com are strictly prohibited from being used to store, display, distribute, advertise, or in any way support child pornography. Gobohost.com will comply with all law enforcement entities to actively enforce this policy, and will report any Customer who violates this policy to the United States FBI and/or Interpol should Gobohost.com become aware of such violations.

Unsolicited Commercial Email / SPAM: Use of services provided by Gobohost.com to transmit or support any type of unsolicited commercial or unsolicited bulk email message (SPAM) is strictly prohibited, and any violation of this policy may result in the immediate termination of services. If you spam, don’t sign up for an account. It’s as simple as that.

Unauthorized Access: Use of services provided by Gobohost.com to gain unauthorized access into any other system or to support any attempt to gain access to any other computer system is strictly prohibited.

Network Activity: Use of services provided by Gobohost.com to attempt to disrupt the network of any other system connected to the internet, i.e. Denial of Service Attacks (DOS), is strictly prohibited and may result in the immediate termination of services. Additionally, IRC services of any kind - clients, servers, bots, etc are strictly prohibited on our network, and the Company reserves the right to filter all IRC related traffic.

Network Security: Gobohost.com will make reasonable attempts to ensure the security of its internal and external networks remain intact, however Client agrees to take reasonable measures to ensure the security of Client’s account, or in the case of accounts which utilize dedicated servers or co-location services, the customer agrees to make every attempt to ensure the security of their individual servers, or will on a regular basis utilize the managed services that are provided by Gobohost.com to ensure the security of the network.

High Resource Usage Policy / Script Usage: Resources are defined as CPU usage, memory usage, bandwidth and other available system resources. Any user found to be abusing or manipulating system resources will be notified that they are in violation of this policy. If this abuse or manipulation continues, Gobohost.com reserves the right to suspend, terminate, or make appropriate changes to prevent future incidents.
 
GoboHost.com reserves the right to modify this agreement at any time without prior notification. Any questions regarding these terms and policies should be directed support@gobohost.com
